The OSP has released the latest update on the case of Charles Bissue v. Office of the Special Prosecutor & Kaneshie District Court.
Full details on the Charles Bissue V Office of the Special Prosecutor
The OSP indicated that a human rights suit brought by Charles Bissue against the Office of the Special Prosecutor (OSP) is set to be referred to another judge.
It further stated that this is the case in which Charles Bissue secured a 10-day injunction application ex parte to stop the OSP from arresting him. His lawyers in the ex parte application, told the court to stop the OSP because the office had secured an arrest warrant unlawfully.
However, the Office of the Special Prosecutor says, it never secured any such warrant.
The presiding judge, Justice Nicolas Mensah Abodakpi, has reached retirement age with a 6-month extension by the Chief Justice to complete a part-heard case pending before him.” The OPS stated this in its tweet.
“However, the court today told the parties that the case was not part of the list of part-heard cases submitted by Justice Abodakpi to complete.”
“In the previous court session, Justice Abodakpai directed both Charles Bissue and the OSP to submit their written arguments.”
“Furthermore, he ordered Nana Agyei Baffour-Awuah, the attorney representing Charles Bissue, to take the witness stand for cross-examination over his assertion that the OSP unlawfully secured an arrest warrant from the Kaneshie District Court.”
‘The OSP has never secured any such warrant.”
According to the OPS, the case “Charles Bissue V Office of the Special Prosecutor & Kaneshie District Court” could not come off today. It has therefore been adjourned to 17 April 2024, when it will be reassigned to a new judge.
