GES sued again by another 256 teachers over promotional exam failure
Ahead of the release of index numbers for the December 19-20 promotion examination, 265 teachers have sued the Ghana Education Service (GES) over promotional exam failure.
The 256 educators used GES and the Attorney General for their mass failure in the December 2021 promotional examinations.
The plaintiffs Assistant Director Grade II position holders who took the 2021 Promotional examination for sat the Assistant Director Grade I promotion examination held at the Ada Training College exam centre.
Speaking on the application brought before the court to right the wrong done the 256 teachers, Mr James Enu, counsel for the applicants (teachers), told the Ghana News Agency that none of the 256 teachers, who wrote the exams at that centre passed, adding that, such an occurrence was bizarre.
The council added that although the GES was petitioned to look into the matter, the teachers in question were told nothing untoward was found, hence they failed the examination.
The 256 teachers are of the view that the Ghana Education Service never carried out an investigation as they had required it to do. The council for the 256 teachers therefore communicated with the GES to furnish it with the scripts and scores, however, the GES failed to respond to the request.
Again, the council for the plaintiffs added that the pass mark for the Teacher Promotion Examination was not made public and candidates did not know it either but were only informed they have failed the examination.
These and other issues prompted the applicants to take legal action against the GES seeking the court to set aside the results of the exam to GES to furnish the applicants with their exams scores and scripts, as well as put an injunction on the defendant to prevent them from organizing other exams until the determination of the case.
The teachers have indicated that the action and inaction of the GES has had affected them psychologically, emotionally, and physically. This has made it challenging for the 256 teachers to properly discharge their duties in their line of duty.
One of the 256 plaintiffs, Mr Mensah said he was asked to use his staff number because he was not furnished with the index number. Again some candidates for the said examination were absent while another got involved in an accident but all of them were declared as failed.

He added that the GES was sued over promotional exam failure to set a good precedent. The case, which will take place at the Tema High Court ‘B’ presided over by Justice Emmanuel Ankamah, has set December 12, 2022, for the movement of the application.
