Kan Dapaah Pursues Substituted Service in Defamation Suit Against Barker-Vormawor
Minister for National Security, Albert Kan Dapaah, has sought a court order for substituted service in a defamation suit filed against Oliver Barker-Vormawor, the convener of the #FixTheCountry movement. This legal move comes after multiple unsuccessful attempts to personally serve Barker-Vormawor with court documents related to the lawsuit.
Background:
Kan Dapaah initiated a defamation lawsuit against Barker-Vormawor following allegations made by the latter. Barker-Vormawor claimed that Kan Dapaah offered him a one-million-dollar bribe to cease the #FixTheCountry demonstrations against the government. In response to these accusations, Kan Dapaah has sought legal redress.
Substituted Service Application:
In his application for substituted service, Kan Dapaah requested the court’s permission to serve Barker-Vormawor via alternative methods due to the inability to locate the defendant for personal service. Kan Dapaah asserted that all efforts to serve Barker-Vormawor at his known place of work had proven unsuccessful.
The minister expressed his belief that substituted service could be effectively carried out by posting copies of the Writ of Summons and Statement of Claim on the court’s notice board for 14 days and through a single publication in the Daily Graphic newspaper.

The High Court is set to hear the ex-parte motion, filed on October 19, on Friday, October 27, 2023.
Kan Dapaah’s Claims:
Kan Dapaah seeks the following from the court in his defamation suit against Barker-Vormawor:
1. A declaration that the statements made by the defendant are defamatory.
2. General damages amounting to ten million Ghana cedis (GH¢10,000,000), inclusive of aggravated and/or exemplary damages for defamation.
3. An apology and retraction of the defamatory statements.
4. A permanent injunction preventing the defendant from making similar or other defamatory statements.
5. Costs incurred during the legal process.
The defamation suit stems from Barker-Vormawor’s accusations that the government attempted to halt #FixTheCountry activism by offering money and positions to its leaders. The legal proceedings have drawn significant public attention and are under close legal scrutiny.
