In fact, Some of the most useless things to read from Ghanaian courts are land judgments.
How do you settle a land dispute and demarcate land without including in the judgment a survey map, and appropriate geographical coordinates?
If you say things like the Plaintiff is entitled to his 20-acre land bounded on the northwest by Adjoa Mansa’s farm and on the east by Kwabena agyri’s kiosk. No map is included and no geographical coordinates are provided.
How exactly can people who deal with the plaintiff know the exact boundaries of the plaintiff’s land? How long will Adjoa Mansa farm her land? Should we go and ask Adjoa Mansa where her farm starts from? And Kwabena Agyiri will never lift his kiosk?
Why do we give judgments like we are directing someone to a Gob3 joint?
Everyday, land litigants both leave court claiming that they have both won. Land disputes are interminable because when a court says a party has won, it doesn’t take the trouble to say clearly where the “won” land is. So that person also goes and breaks people’s buildings everywhere they want. Because courts are giving writs of possession that say, “you have the right to possess the disputed land”. Where exactly is the “disputed land”, is left with the person themselves to determine.
Even worse, there have been several instances where different courts have awarded the same land or portions of it to different individuals. None of them demarcate clearly which land is which, or where it starts and ends.
Imagine if the Chamber of the law of the Sea Tribunal had failed to show exactly where Ghana’s maritime boundaries lay vis-a-vis Cote D’Ivoire on a map and stated clearly the geographical coordinates, do you think either party would have gone home with certainty?
